§1. Who provides the service

  1. The Service Provider is MEDIA DIGITAL BUSINESS L.L.C.-FZ (license number 015913191), with its registered office at: Meydan Grandstand, 6th floor, Meydan Road, Nad Al Sheba, Dubai, United Arab Emirates, operating the brand ScallMe (scall.me).

  3. At the client's request, the VAT invoice may be issued by an affiliated entity registered in Poland instead of the UAE entity.

§2. Scope of the Terms

  1. These Terms set out the rules for using the free website draft service, available at scall.me/demo/ and in variants of that page.
  2. The service works as follows: the User answers the wizard's questions, and on that basis the Service Provider prepares an illustrative, demonstration version of a website and sends the User a link to it.
  3. The service is free of charge and does not oblige the User to purchase anything.

§3. Terms of use

  1. The service may be used by a person aged 18 or over, acting on their own behalf or on behalf of a company they are authorized to represent.
  2. The User provides truthful information, in particular the company name and the phone number or email address to which the link is to be sent.
  3. Providing the data of third parties without their knowledge is prohibited, in particular another person's phone number or email address.
  4. The Service Provider may limit the number of drafts prepared for a single phone number, email address, or IP address. The current limit is 2 drafts per 24 hours.
  5. The Service Provider may refuse to prepare a draft, in particular when the submission is clearly false, a test, offensive, or concerns unlawful activity.

§4. What a draft is and what it is not

  1. A draft is an illustrative version. It shows the layout, sections, and visual direction. It is not a finished product and may differ from the version that would be created as part of a paid project.
  2. The draft is published at a temporary technical address on the domain demo.websystemz.com, tagged noindex, which means it is not intended to be indexed by search engines.
  3. The Service Provider does not guarantee the availability of the draft for any specific period and may delete it, in particular after 90 days from when it was shared.
  4. The content and photos used in the draft are samples. Industry photos come from services that provide them under free licenses and do not depict the User's company.
  5. Company information may come from publicly available sources, including the Google Maps business profile and social media profiles indicated by the User.

§5. Rights to the draft

  1. The economic copyrights to the draft, including the code, graphic layout, and content prepared by the Service Provider, remain with the Service Provider.
  2. The User may view the draft and show it to other people for the purpose of deciding whether to order a website. The User does not acquire the right to use the draft on their own domain, or to copy, modify, or resell it.
  3. Rights to the website are transferred only on the basis of a separate, paid agreement and after payment of the agreed fee.
  4. Websites prepared by the Service Provider include in the footer an authorship credit for scall.me. Removing this credit requires separate arrangements with the Service Provider.
  5. The company name, logo, and materials provided by the User remain the User's property. The User consents to the Service Provider using them solely to prepare and share the draft.

§6. Contact and consents

  1. Submitting a request requires accepting the Terms and consenting to be contacted regarding the prepared draft. Without this, the service cannot be performed.
  2. Contact regarding the draft includes one message with a link and any messages necessary to perform the service.
  3. Consent to receive commercial and marketing information (offers, discounts, news) by SMS and email is voluntary, separate, and not a condition for the performance of the service. It can be withdrawn at any time by replying to any message or by writing to the contact address. Withdrawal of consent does not affect the lawfulness of actions taken before the withdrawal.

§7. Complaints

  1. Complaints can be submitted to [email protected], stating the phone number or email address used in the request and a description of the objections.
  2. The Service Provider will process a complaint within 14 days and respond through the same channel through which the complaint was received.
  3. Consumers may use out-of-court complaint and redress procedures, including the European Commission's ODR platform.

§8. Liability

  1. The service is free of charge and illustrative in nature. The Service Provider is not liable for business decisions made on the basis of the draft.
  2. The Service Provider is not liable for service interruptions resulting from causes beyond its control, in particular failures on the part of hosting, SMS gateway, or email providers.
  3. The above limitations do not exclude or limit consumer rights arising from mandatory provisions of law.

§9. Technical requirements

Using the service requires a device with internet access, an up-to-date browser with JavaScript enabled, and an active mobile phone number or email address.

§10. Final provisions

  1. Matters not governed by these Terms are subject to Polish law. The choice of law does not deprive consumers of the protection afforded by the laws of the country of their habitual residence.
  2. The Service Provider may amend the Terms for valid reasons, in particular changes in the law or in the scope of the service. An amendment takes effect 14 days after publication and does not apply to requests submitted earlier.
